Former SC judges FR case to be supported on Friday

A Fundamental Rights application filed by Former Supreme Court judge Sarath de Abrew over the decision by the Attorney General to indict him in the High Court of grave sexual assault on a female domestic aide was fixed to be supported on Friday (Dec 04). The petition was taken up today before the bench, Chief Justice K. Sripavan, Justices Priyantha Jayawardena and Anil Gooneratne. The court ordered to issue notice on the first and sixth respondents in the case. They included the Mt Lavinia police who investigated the complaint by the domestic aide.

Additional Solicitor General Yasantha Kodagoda, PC, appearing on behalf of Attorney General said that the victim (domestic aide), in this case referred should be cited as a respondent. He said if the victim in this case is not cited as the respondent she would be deprived of her rights. Lawyer Pulasthi Hewamanna watching the interest of the victim also said she should be cited as a respondent. Manohara de Silva, PC, appeared for the petitioner.
